Data Processing on Our Website
Data processing on this website is carried out by us, SWH GmbH. The following statement provides an overview of what personal data we collect, for what purposes, during your visit to our website, and how this data is used. The following processing activities may take place:
Collection and processing of your contact information when you use the contact form
; processing of your IP address for the technical provision of the service. In this context, we cannot link your IP address to you.
When you visit our website, your browsing behavior may be analyzed for statistical purposes. This is primarily done using cookies and so-called analytics tools. No conclusions can be drawn about your personal user behavior from this data.
If we include external links on our pages that redirect you to other service providers, you can recognize these by the link icon for external links. If you click on an external link, your IP address will be visible to the provider of that site. SWH GmbH does not transfer your data to third parties.
Contact Form
If you use the contact form to get in touch with us, the information you provide will be transmitted to us. When you submit inquiries to us via the contact form, we store the information from the inquiry form—including the contact details you provided there—for the purpose of processing your inquiry and in case of follow-up questions. The processing of the data entered into the contact form is therefore based exclusively on your consent (Art. 6(1)(a) GDPR). You may revoke this consent at any time. To do so, simply send us an informal email. The lawfulness of the data processing operations carried out up until the withdrawal remains unaffected by the withdrawal. The data you enter in the contact form will remain with us until you request that we delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies (e.g., after your inquiry has been fully processed). Mandatory legal provisions—in particular retention periods—remain unaffected.
Inquiries via Email, Phone, or Fax
You also have the option of contacting SWH GmbH by calling us or scheduling a callback. If you contact us via email, phone, or fax, your inquiry—including all personal data contained therein (name, inquiry)—will be stored and processed by us for the purpose of handling your request. Data collection takes place as part of the business initiation process to the extent necessary for the provision of our services and, at that point, falls under the scope of the General Data Protection Regulation (GDPR).
Unless the data is still required for the performance of a contract or pre-contractual measures, it will be deleted thereafter.
Processing of Your IP Address When Using the Website; Creation of Log Files
Each time you access the SWH GmbH website, information transmitted by your browser is automatically stored on a temporary basis. The log file created records the browser type and version, the operating system used, the name and URL of the file accessed, the referrer URL (the previously visited page), the hostname of the accessing computer (IP address), and the date and time of the server request. This data is not combined with other data sources. The storage and processing of this data serve exclusively to ensure system security and to optimize the website.
The IP address identifies the Internet connection through which you are connected to the Internet.
The IP address itself does not directly identify you, as most Internet connections use a different IP address every day.
Your Internet service provider is nevertheless able to identify your connection based on the IP address and a time stamp. In doing so, the provider must comply with the Telecommunications Act (TKG) and may establish this link only under certain conditions.
Another way to establish a direct link between your IP address and you is through the use of cookies. Providers with whom you are registered by name (e.g., Google) can also use a cookie to associate your IP address with your Google account.
Cookies
Some of the web pages on this site use so-called cookies. Cookies do not harm your computer and do not contain viruses. Cookies serve to make our website more user-friendly, effective, and secure. Cookies are small text files that are stored on your computer and saved by your browser.
Most of the cookies we use are so-called “session cookies.” They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies—known as persistent cookies—enable us to recognize your browser the next time you visit.
You can configure your browser to notify you when cookies are set and to allow cookies only on a case-by-case basis, to block cookies in specific cases or generally, and to enable the automatic deletion of cookies when you close your browser. If you disable cookies, the functionality of this website may be limited.
Pixels
Pixels are small images (usually invisible) on a website or, for example, in an email. Pixels collect information about your browser or device and can set cookies.
In addition, cookies may be used by the company that operates the website you are visiting (“first-party cookies”) or by other companies (“third-party cookies”).
You can also find information on managing cookies and similar technologies in your browser on the website of the Verbraucherzentrale NRW e.V.: https://www.verbraucherzentrale.de/wissen/digitale-welt/datenschutz/cookies-kontrollieren-und-verwalten-11996.
Further information on cookies has been compiled by the Federal Association of the Digital Economy (BVDW) e. V., Berliner Allee 57, 40212 Düsseldorf (www.meine-cookies.org).
The following cookies may be used on our websites:
Technically Necessary Cookies
These cookies must always be set to enable the basic functions and proper use of our website.
YouTube with Enhanced Privacy
Our website uses plugins from YouTube. The operator of these pages is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland. This service uses cookies (unless “Privacy-Enhanced Mode” is enabled) to display videos to you. This list contains all personal data processed by or through the use of this service:
IP address

, videos
viewed. The legal basis for processing is your consent, which you grant to us via the cookie banner and may revoke (Art. 6(1)(a) GDPR).
The data is deleted as soon as it is no longer needed for the purposes of processing. The recipients of the personal data are:
Alphabet Inc.
, Google LLC
, Google Ireland Limited
. We use YouTube in enhanced privacy mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch a video. However, the enhanced privacy mode does not necessarily preclude the sharing of data with YouTube partners. For example, YouTube establishes a connection to the Google DoubleClick network regardless of whether you watch a video.
As soon as you start a YouTube video on our website, a connection is established with YouTube’s servers. In the process, the YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to directly associate your browsing behavior with your personal profile. You can prevent this by logging out of your YouTube account.
Transfer to Third Countries
Some services transfer the collected data to another country. Below is a list of the countries to which the data is transferred. This may occur for various purposes, such as global storage or processing.

We use the Google Maps API on our website. The operator of the site is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland
. Google Maps allows us to better show you locations and optimize our service for you. Google Maps allows you to use the route planner, view locations, or find the fastest route using directions. When you use Google Maps, data is transmitted to Google and processed and stored on its servers. Google uses this data primarily to optimize its own services and to provide you with individualized, personalized advertising.
The following data is collected and, in some cases, stored during use:

The legal basis for data processing is your consent (Art. 6(1)(a) GDPR). You may withdraw your consent at any time in accordance with Article 7(3) GDPR. No further data will be collected after withdrawal. The lawfulness of the processing carried out prior to revocation remains unaffected.
For more information, please see Google’s Privacy Policy at https://www.google.com/intl/de/policies/privacy/.

Use of Google Fonts
We use so-called Google Fonts, provided by Google, on our website to ensure a consistent font display. The Google Fonts are installed locally. No connection to Google’s servers is established in this process.
The legal basis for data processing is legitimate interest (Art. 6(1)(f) GDPR). This legitimate interest arises from the necessary functionality of our website.
Our Social Media Presence
Data Processing by Social Networks
We maintain publicly accessible profiles on social networks. The specific social networks we use are listed below.
Social networks such as Facebook, LinkedIn, Google+, etc., can generally analyze your user behavior in detail when you visit their website or a website with integrated social media content (e.g., “Like” buttons or advertising banners). Visiting our social media profiles triggers numerous data processing operations relevant to data protection.
If you are logged into your social media account and visit our social media profile, the operator of the social media platform can associate this visit with your user account. However, your personal data may also be collected even if you are not logged in or do not have an account with the respective social media platform. In this case, data collection occurs, for example, via cookies stored on your device or by recording your IP address.
Using the data collected in this way, the operators of social media platforms can create user profiles that store your preferences and interests. This allows interest-based advertising to be displayed to you both on and off the respective social media platform. If you have an account on the respective social network, interest-based advertising may be displayed on all devices on which you are currently logged in or have been logged in.
Please also note that we cannot track all processing activities on the social media platforms. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media platforms. For details, please refer to the terms of use and privacy policies of the respective social media platforms.
We have integrated the following social media accounts:
Facebook Privacy Policy:
https://de-de.facebook.com/privacy/policy/?entry_point=data_policy_redirect&entry=0
LinkedIn Privacy Policy:
https://de.linkedin.com/legal/privacy-policy
The legal basis for data processing is your consent (Art. 6(1)(a) GDPR). You may revoke your consent at any time in accordance with Article 7(3) GDPR. No further data will be collected after revocation. The lawfulness of the processing carried out prior to revocation remains unaffected.
When you visit one of our social media pages (e.g., Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered by that visit and have entered into a corresponding agreement with them. This agreement specifies which data processing operations we and our social media partners are responsible for when you use our social media channels.
Please note that, despite our joint responsibility with the social media platform operators, we do not have full control over the data processing operations of the social media platforms. Our capabilities are largely determined by the corporate policies of the respective provider.
Retention Period
The data collected directly by us through our social media presence is deleted from our systems as soon as the purpose for its storage no longer applies, you request that we delete it, you revoke your consent to its storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions—in particular retention periods—remain unaffected.
We have no influence over the retention period of your data that is stored by social media platform operators for their own purposes. For details on this, please contact the following social media platform operators directly.
We have a profile on Facebook. The provider is Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA.
We have a profile on LinkedIn, a provider headquartered at 2029 Stierlin Court, Mountain View, CA 94043, USA1
Use of Google Analytics via Google Tag Manager
Our website uses Google Analytics, a web analytics service provided by Google LLC in California, USA. Google Analytics is integrated into our website via Google Tag Manager (provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland).
Google Analytics uses so-called “cookies,” which are text files stored on your computer that enable an analysis of your use of the website. Through integration via Google Tag Manager, we receive additional information about how you interact with our website. This information is relevant to us for tailoring our website to your interests. For example, we receive information about how long you stay on our website or on individual subpages, as well as the number of clicks, and can use this to determine which content interests you.
Google Tag Manager itself merely forwards the collected data to Google Analytics. Data processing is primarily carried out by Google LLC. The information generated by the cookie regarding your use of this website is typically transmitted in anonymized form to a Google server in the United States and stored there. In addition to Google, government authorities may also gain access to this data under U.S. law, provided certain legal requirements are met. Unfortunately, we have no control over this. Google has the ability to link your data with other data it holds about you, such as your search history, personal accounts, usage data from other devices, and any other data Google has about you.
Google collects the following data
Your IP address in truncated form (using anonymizeIp)
Location (country and city)
Language
Operating
system Device type
Browser
Computer
resolution Referrer (e.g., search engine)
User behavior (content viewed, time spent on the site, files downloaded)
The legal basis for data processing is your consent (Art. 6(1)(a) GDPR). You may withdraw your consent at any time in accordance with Article 7(3) GDPR. No further data will be collected after withdrawal. The lawfulness of the processing that took place prior to revocation remains unaffected.
You can effectively revoke your consent at any time by reopening the cookie settings. To do so, please use the button displayed at the bottom of the screen.

Meta Pixel (formerly Facebook Pixel)
This website uses Meta’s visitor action pixel to measure conversions. The provider of this service is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Dublin, D04 X2K5, Ireland. According to Meta, however, the data collected is also transferred to the United States and other third countries.
This enables the behaviour of website visitors to be tracked after they have been redirected to the provider’s website by clicking on a Meta advertisement. This allows the effectiveness of Meta advertisements to be evaluated for statistical and market research purposes and future advertising activities to be optimised.
The data collected is anonymous to us as the operator of this website, and we cannot draw any conclusions about the identity of users. However, the data is stored and processed by Meta, making it possible to link it to the respective user profile on Facebook or Instagram. Meta may also use the data for its own advertising purposes in accordance with Meta’s Data Policy (https://de-de.facebook.com/about/privacy/). This enables Meta to display advertisements on Facebook, Instagram and other advertising channels. As the website operator, we have no influence over this use of the data.
This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You may withdraw your consent at any time.
Where personal data is collected on our website using the tool described here and transmitted to Meta, we and Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Dublin, D04 X2K5, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). This joint responsibility is limited exclusively to the collection of the data and its transmission to Meta. Any processing carried out by Meta after the data has been transmitted does not fall within the scope of our joint responsibility. Our respective obligations have been set out in an agreement on joint processing. The full text of this agreement is available at: https://www.facebook.com/legal/controller_addendum. Under this agreement, we are responsible for providing privacy information when using the Meta tool and for implementing the tool on our website in a manner that complies with data protection requirements. Meta is responsible for the data security of its products. You may exercise your data subject rights (e.g. the right to access your data) concerning data processed by Facebook or Instagram directly with Meta. If you exercise your data subject rights with us, we are required to forward your request to Meta.
Data transfers to the United States are based on the European Commission’s Standard Contractual Clauses. Further details are available here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.
Further information on protecting your privacy can be found in Meta’s Privacy Policy: https://de-de.facebook.com/about/privacy/.
You can also disable the remarketing feature “Custom Audiences” in your ad settings at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do so.
If you do not have a Facebook or Instagram account, you can opt out of usage-based advertising from Meta on the European Interactive Digital Advertising Alliance website: http://www.youronlinechoices.com/de/praferenzmanagement/.
The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the United States intended to ensure compliance with European data protection standards when personal data is processed in the United States. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/4452.

However, if you recognize yourself in one of the photos without having been informed about it, or if you believe you did not give your consent, please contact our Data Protection Officer immediately using the contact information provided.
Legal Basis for Processing
To the extent that we obtain your consent for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. You can effectively withdraw your consent at any time by reopening the cookie settings. To do so, please use the button displayed at the bottom of the screen.
When processing personal data necessary to fulfill a contract to which you are a party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations necessary to take steps prior to entering into a contract.
To the extent that the processing of personal data is necessary to comply with a legal obligation to which PartG mbB is subject, Article 6(1)(c) of the GDPR serves as the legal basis.
If the processing of personal data is necessary to protect the legitimate interests of SWH GmbH, Article 6(1)(f) of the GDPR serves as the legal basis.
Data Erasure / Retention Period
Your personal data will be deleted as soon as the purpose for which it was stored no longer applies. Data may also be retained if this is provided for by European or national legislators in EU regulations, laws, or other provisions to which SWH GmbH is subject. Data will also be deleted when a retention period prescribed by the aforementioned standards expires, unless further storage of the data is necessary for the conclusion or performance of a contract.
Security
SWH GmbH cannot guarantee the security of data transmission over the Internet. Communications via email are not encrypted. Therefore, it cannot be ruled out that third parties may gain access to them. It is therefore recommended that confidential information be sent exclusively by mail.
Mandatory Information pursuant to Art. 13 (Direct Collection from the Data Subject) and Art. 14 (Collection of Data from Third Parties) of the European General Data Protection Regulation (GDPR)
The following information provides an overview of how we handle personal data and your rights, regardless of whether you use our website.
We collect personal data in connection with the provision of our consulting and support services in our fields of practice, e.g., as tax advisors and attorneys.
To this end, we have compiled the following privacy notice for you, in addition to the “General Information.”
Purposes and Legal Bases for Processing
The legal bases for processing the data are:
Processing for the performance of contracts we enter into, pursuant to Art. 6(1)(b) of the GDPR
. If personal data is collected and processed for the purpose of initiating or executing a contract, this data is used for the conclusion of the contract, the performance of the contractual relationship, and, if applicable, its termination. This includes communication with business partners regarding the services and projects offered, as well as other products—for example, to process inquiries from the business partner. Furthermore, data processing serves to plan, execute, and manage the business relationship, for example, to handle the commissioning of services, for accounting purposes, or for billing.
Processing to Protect Legitimate Interests Pursuant to Art. 6(1)(f) GDPR
We also process personal data to protect our legitimate business interests, those of our customers, and, where applicable, the interests of third parties. This may be necessary, for example, to ensure IT security and IT operations; to fulfill accountability and/or documentation obligations toward our business partners, customers, or regulatory authorities; to prevent and investigate criminal offenses or administrative offenses; to enforce our right of access to our premises; and for sales and marketing purposes.
Processing Based on Consent, Art. 6(1)(a) GDPR: To the extent that we obtain consent from data subjects for specific purposes, e.g., for sending newsletters, we process the data collected for this purpose only within the scope of the purposes specified in the consent.
Processing to fulfill legal obligations, Art. 6(1)(c) GDPR
We process personal data to the extent necessary to comply with legal obligations to which we are subject, e.g., in connection with compliance with record-keeping requirements under the German Commercial Code and the German Fiscal Code.
Categories of data we collect from third parties
We receive the following categories of personal data from third parties
Business contact information such as first and last names, address, telephone number, cell phone number, fax number, and email address, e.g., of the respective contact persons.
All data collected in the course of our business activities or in connection with projects that involves personal data of data subjects disclosed to us in connection with the services we offer. Depending on the service, this may include, for example, the contact information of data subjects or additional details, provided that such information is transmitted to us in connection with our business activities.
Sources (third parties) from which personal data is obtained
We process personal data to the extent that it has been provided or transmitted to us directly by the data subjects or by third parties. If we also receive personal data from third parties, the following entities may be involved:
business partners or government agencies in connection with the fulfillment of contractual obligations or the fulfillment of a legal obligation.
Recipients or Categories of Recipients of Personal Data
Only those individuals within our organization who require access to personal data in order to perform their respective legitimate duties are granted such access.
If we engage external service providers in individual cases, we ensure that appropriate technical and organizational measures are implemented and necessary agreements are concluded so that processing is carried out in accordance with applicable data protection regulations and safeguards the rights of the data subject.
Depending on the context of processing, the following categories of recipients may be involved:
business partners to whom the transfer of data is necessary for the performance of tasks, such as our clients/customers, payment service providers/banks, postal/package services, external consultants, etc.
Government agencies for the purpose of fulfilling statutory reporting or disclosure obligations (e.g., tax authorities, police and public prosecutors, regulatory authorities)
Other third parties, provided that you have given us your consent to the data transfer or there is a legal basis for the data transfer (e.g., attorneys, insolvency administrators)
Transfer to a Third Country or an International Organization
As a general rule, there is no regular transfer of personal data to a third country (countries outside the European Union or the European Economic Area) or to an international organization. In cases where we communicate with our business partners, etc., via Microsoft Teams or Zoom, a data transfer to the United States cannot be ruled out. In such cases, the transfer is covered by the conclusion of standard contractual clauses as well as by supplementary safeguards.
Retention Period and Criteria for Determining the Duration
We store personal data only for as long as permitted under the applicable legal basis, in particular for as long as necessary to fulfill a contract, to comply with retention obligations (including obligations to provide evidence and accountability), based on overriding legitimate interests, or until consent on which the processing was based is revoked.
Rights of the Data Subject
When your personal data is collected, you have the following rights:
Right of access, Art. 15 GDPR: Pursuant to Art. 15(1) GDPR, you have the right to request confirmation as to whether personal data concerning you is being processed. You also have the right to access this personal data as well as to receive the additional information specified in Article 15(1)(a) through (h) of the GDPR.
Right to rectification, Article 16 of the GDPR: If the personal data stored about you is inaccurate or incomplete in light of the purposes of processing, you have the right under Article 16 of the GDPR to request that the personal data be rectified or completed.
Right to erasure, Article 17 of the GDPR: Under Article 17(1) of the GDPR, you have the right to request the erasure of your personal data if its processing is unlawful for any of the reasons listed in Article 17(1)(a) through (f) of the GDPR. However, we are not obligated to erase the data if further processing is necessary in the cases specified in Article 17(3) of the GDPR, e.g., to comply with legal obligations.
Right to restriction of processing, Article 18 of the GDPR: You have the right to request the restriction of processing (blocking) in the cases specified in Article 18(1)(a) through (d) of the GDPR.
Right to Data Portability under Article 20 of the GDPR: You have the right to receive your personal data—which you have provided to us yourself and which we process automatically based on your consent or a contract—in a commonly used, machine-readable format.
Right to Object, Article 21 of the GDPR: You have the right to object at any time to the processing of your personal data that is carried out on the basis of our legitimate interests or those of a third party (Article 6(1)(f) of the GDPR). In the event of an objection, we will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing is necessary for the establishment, exercise, or defense of legal claims. If the objection is directed against direct marketing (including any associated profiling), data processing will no longer take place.
Withdrawal of Consent
You have the right to withdraw your consent at any time and without providing a reason. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of your consent prior to withdrawal.
To exercise your rights, please contact us; you can find our contact information in Section I, “General Provisions.”
Right to File a Complaint with a Supervisory Authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, your workplace, or the location of the alleged infringement, if you believe that the processing of your personal data violates the GDPR.
You can find the contact information for the supervisory authority responsible for us in Section I of this statement, under “General Provisions”
Obligation to Provide Personal Data
An obligation to provide certain personal data may arise from contracts that have been or are to be concluded, to the extent that such provision is necessary for the conclusion or performance of the contract. Furthermore, there may be legal obligations that require us to collect or process certain data. In the case of data required for a contract, the contract cannot be concluded if the information is missing. If data must be provided due to legal obligations, the associated service cannot be rendered without such provision.
Automated Decision-Making or Profiling
Automated decision-making in individual cases, including profiling pursuant to Article 22 of the GDPR, does not take place.
